Don's ownership of the Libs because plates are bigger than straws is just the best. As in, I'm genuinely curious as to whether or not he actually sees the logical flaw in that plates have an obvious functional element to their utility that straws lack and is just playing on the fact that his supporters are too stupid to recognize it, or if he himself is just too fucking stupid to recognize it. I'd honestly probably assume the latter, though either way he really is special. Good for him.

The logical flaw is that in the vast majority of places where straws are used, the plate (or packaging for take-out) is made out of something other than non-biodegradable plastic.

What the customer might be using the straw for isn't terribly important, and some customers really do have a special need for them-- which is why almost all of these laws say customers who ask for straws should still get them.

Pretty much any offense is potentially impeachable.

All you need is a majority vote in the House. There's no legal standard or precedent restricting "high crimes and misdemeanors," because a vote to serve articles of impeachment is not a trial. There's no judge, there's no attorney for the accused, there's no jury or burden of proof or standard of evidence.

If you can convince more than half of the House that the president's dirty toenails are unbecoming conduct, then you can impeach. If you can't convince half of the House that eating 17 babies in one sitting is an impeachable offense, then you can't impeach.

It's a purely political process. Maybe that's a bad thing, maybe not, but any American middle-school graduate should be able to explain this to you.

Hey @7 I think @5 is speaking in normative terms, rather than operative terms. The Constitution does have language indicating that bad toenails are not grounds, there's just no means to enforce that besides personal integrity plus the ballot box.

If you haven't read Charles Black's book, do, he's a lot more interesting than counting votes.

Look, guys, the gun-toting attacks on government faculties are not actually helpful. Getting shot by cops didn't accomplish one thing for one person in there, nor did it move public opinion in a direction that will. I know you (the guy into this) think it's helpful because it inspires similar thinkers to similar actions. But the thing is, 100x the gun-toting attacks would not help. You're outgunned.

Organizing huge crowds to block activity, great. Welding yourself to block activity, that too. Unarmed destruction of ICE property, we can talk (you've got to have smart PR and I don't trust you guys to be smart on how the non-fringe thinks).

With that his weapon “appeared to have sustained some type of malfunction during the incident”, no cop was injured, and it hasn't been stated he fired any shots, it's a possibility he was not armed in actuality, just had a prop to get himself killed. Which would benefit a non-violent anarchist's own feelings, but does not make it work as a non-violent action. @7 whether impeachment is a purely political process has no impact on what constitutes legitimate ground for impeachment. I am not sure if that's middle school logic but you surely failed it.

Again, "treason, bribery, or high crimes and misdemeanors" is as restrictive as the constitution gets, there is no additional language in the document "indicating that bad toenails are not grounds." If we are to take the phrase "high crimes and misdemeanors" to mean what it did in English law at the time the US constitution was drafted, then we are looking at something that covers a very wide range of behaviors, extending well beyond the boundaries of mere crime. The "high" refers to the office, and the phrase was understood to mean more or less anything unbecoming of a person holding such office, including all sorts of breaches of etiquette that one might tolerate or even expect in the rabble, e.g. habitual intoxication. Ben Franklin offered that impeachment was called for whenever a president "rendered himself obnoxious." I picked "bad toenails" as a deliberate and only slightly exaggerated example of what might be considered unbecoming conduct in a head of state.

If Charles Black expressed the hope that the impeachment process be kept as apolitical as possible, then I certainly appreciate the sentiment, but it has no legal weight. No normative statement has any practical or legal bearing here. Any idealistic notions to the contrary should have been firmly dispelled in October of 1988.

I want Trump's bullshit aired in Congress via impeachment proceedings as much as anyone, but it shouldn't be over the Russia thing. It should be over his absolute abuse of the emoluments clause, and the cronyism that is enriching his family while demonstrably creating conflicts of interest. Let's not kid ourselves, though. It would very likely backfire. No Republican is going to even consider voting for it because their constituencies would decisively and immediately turn on them. In the end though, I'm inclined to trust Pelosi's judgement more than my own when it comes to this stuff, because I'm so goddamn angry and horrified I can't see straight. And neither can most of you.
